United States — federal
Phenibut is not a federally scheduled controlled substance and is not an FDA-approved drug. The FDA has determined it does not meet the statutory definition of a dietary ingredient, so a dietary supplement declaring phenibut is misbranded; the FDA has also treated phenibut products as unapproved new drugs and as unsafe food additives. The U.S. Drug Enforcement Administration notes that a compound absent from the schedules may still raise Controlled Substance Analogue Act questions, and recommends an official determination where classification matters. Phenibut is also on the U.S. Department of Defense Prohibited Dietary Supplement Ingredients list (prohibited for service members).
